General terms and conditions of sale

1. Preamble

These general terms and conditions of sale are concluded between, on the one hand, the company BeldiMade, LLC with a capital of 30,000 Moroccan dirhams, registered with the Trade Register of Marrakech, Morocco under number 144681, with its head office located at: No. B14, Résidence Fajwa, Bd Hassan II, Route d’Essaouira, Gueliz, Marrakech, Morocco, hereinafter referred to as “BeldiMade” or “we”, and, on the other hand, the individuals wishing to make a purchase via the BeldiMade website, accessible at www.beldimade.com, hereinafter referred to as “the client” or “you”.

The website www.beldimade.com is a platform that facilitates the connection between artisans and cooperatives based in Morocco and customers mainly located in France and Europe. BeldiMade acts as an intermediary, managing financial transactions, taking a commission on sales made, and ensuring that the remaining payment is correctly transferred to the artisans and cooperatives after deducting appropriate transaction fees.

The purpose of these general terms and conditions of sale is to define the rights and obligations of the parties in the context of the online sale of items offered by Moroccan artisans and cooperatives through the BeldiMade website. Any order placed on this site implies the customer’s unreserved acceptance of these general terms and conditions of sale.

2. Purpose

These general terms and conditions of sale aim to define the contractual modalities between BeldiMade and the client, from the ordering of products to their delivery, including payment and after-sales service terms. They govern all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

The BeldiMade platform allows clients to:

– Discover products made by Moroccan artisans and cooperatives.
– Select these products to add to their shopping cart.
– Proceed to payment for these products under the provided conditions.
– Have these products delivered to a specified address in accordance with the stated provisions.

BeldiMade ensures mediation between Moroccan artisans and cooperatives and the clients, facilitating commercial transactions by collecting online payments, managing orders, and coordinating delivery while taking a defined commission for its services. The products offered for sale by the artisans and cooperatives are described and presented as accurately as possible on the BeldiMade website.

The conclusion of a sale will only be considered final after BeldiMade sends the client confirmation of the order acceptance by email and after the full payment has been received.

It is specified that the products are intended for sale only to buyers residing in France and Europe and for deliveries required in these geographical areas.

3. Orders

3.1 Placing the Order

To place an order, the client must follow the online purchase process, which includes selecting product(s), adding them to the cart, and proceeding to checkout where the necessary information for order management must be provided. All steps necessary for the sale will be specified on our website.

Once the order is placed, BeldiMade will confirm its receipt by sending an email to the client. This confirmation email will summarize the ordered items, prices, and delivery charges if applicable.

3.2 Order Validation

The order will only be considered effective when the concerned banking payment centers have given their approval and when the artisan or cooperative offering the item has confirmed its availability and ability to ship it within the specified timeframe.

In case of refusal by the payment centers, the order will be automatically canceled and the client will be informed by email.

Similarly, BeldiMade reserves the right to refuse any order from a client with whom there exists a dispute regarding the payment of a previous order or for any other legitimate reason related to the client’s abnormal order.

3.3 Order Modification

Once the order is validated and before its shipment, the client can request the modification of certain elements of the order (delivery address, etc.) by contacting BeldiMade customer service. However, if the order has already been processed and shipped, modifications can no longer be taken into account.

3.4 Order Cancellation

Only BeldiMade and the cooperative offering the item can cancel an order. If you are a buyer and wish to request a cancellation, please contact BeldiMade customer service directly.

In case of order cancellation after product shipment, the return and refund conditions specified in the section related to returns and refunds will apply.

4. Products and Availability

4.1 Product Description

The products sold by the artisans, cooperatives, and our partners on our platform are those listed on the site on the day of consultation by the client, within the limits of available stocks.

Each product is accompanied by a description prepared by the supplier, artisan, or cooperative. The product photographs, although aiming to be as faithful as possible, do not bind the seller if errors have been introduced.

4.2 Product Availability

Product and price offers are valid as long as they are visible on the site, within the limits of available stocks with the artisans and cooperatives. In case of product unavailability after placing the order, the client will be informed by email of the waiting times to receive the product or the cancellation of their order if no alternative product can be offered.

In case of debit or collection aiming at the order of an unavailable product, BeldiMade commits to refund the client as soon as possible and at the latest within 30 days following the payment of the amounts paid.

4.3 Information Updates

BeldiMade reserves the right to modify the product information presented at any time and without prior notice, without engaging its responsibility. The information (name, definition, product reproduction, technical details, etc.) presenting the products is provided by the artisans and cooperatives.

4.4 Product Compliance

The products offered for sale on the site comply with Moroccan legislation and applicable standards in Morocco. BeldiMade strives to ensure that product descriptions, provided by the artisans and cooperatives, are as accurate as possible. However, BeldiMade’s responsibility cannot be engaged in case of minor non-conformities or non-substantial errors in product descriptions.

5. Prices

5.1 Price Display

Product prices are indicated in Euros (€) and Moroccan Dirhams (MAD) and are clearly defined on each product page. These prices include the applicable value-added tax (VAT) on the order date but do not include delivery charges (except for special offers), which are calculated and added to the order total during the finalization process.

5.2 Delivery Charges

Delivery charges vary according to the weight and destination of the shipment. They are determined by the artisans or cooperatives shipping the products and are communicated to the client before the final validation of the order.

5.3 Price Changes

BeldiMade reserves the right to modify its prices at any time, but the products will be billed based on the rates in effect at the time of order validation, subject to availability.

5.4 Price Errors

Occasional errors or omissions may occur regarding the price displayed on the site. If a product is listed at an incorrect price, BeldiMade has the right to refuse or cancel any order placed for the product listed at the incorrect price, even if the order has been confirmed and your bank account has been debited. If your account has already been debited for the purchase and your order is canceled, BeldiMade will issue a full refund for the amount paid.

5.5 Promotions and Discounts

Promotions and discounts are offered during defined periods and are clearly displayed on the site. The applicable conditions for these promotions and discounts are available and can be consulted by the client on the site.

6. Payment

6.1 Payment Methods

Purchases on BeldiMade.com are paid for at the time of the final order validation and can be made using one of the following methods:

– Credit card (Visa or MasterCard)
– Payment via a web link
– Other available electronic payment methods

The payment information provided by the client during the transaction is secured by an SSL (Secure Socket Layer) encryption system and processed by our payment partner PayZone.

6.2 Payment Security

BeldiMade uses a secure payment service provided by our PayZone provider, which integrates the SSL security standard. No client’s banking information is stored on the BeldiMade site. BeldiMade’s responsibility cannot be engaged in case of fraud or misuse of banking data following a transaction on its site.

6.3 Late or Refused Payment

If the banking payment center refuses to authorize payment, the order will be automatically canceled and the client will be informed by email. Additionally, BeldiMade reserves the right to refuse any order from a client with whom there is an ongoing payment dispute.

6.4 Billing

An invoice detailing the order and including VAT will be automatically generated and sent to the client by email once the order is validated and payment made.

6.5 Non-payment

BeldiMade reserves the right to refuse to deliver or honor an order from a client who has not fully or partially settled a previous order or with whom a payment dispute is in progress.

7. Delivery

7.1 General Information

Products purchased on BeldiMade.com are shipped directly by artisans or cooperatives located in Morocco. Delivery is made to the address provided by the client during the order process. It is the client’s responsibility to provide accurate and complete information to ensure efficient delivery.

7.2 Delivery Times

Delivery times vary depending on the destination and product availability (whether they are catalog products or custom-made products). The delivery times communicated during order validation are indicative. Although BeldiMade and the artisans and cooperatives strive to meet these deadlines, delays may occur due to reasons such as manufacturing delays, logistical or customs issues, or other unforeseeable situations. In case of significant delay, the client will be informed by email.

7.3. Delivery Charges

Delivery charges are calculated based on the destination, weight, and volume of the ordered items. The total delivery charges will be indicated to the client before the final confirmation of the order.

7.4. Delivery Tracking

Once the order is shipped by the cooperative, depending on the option of tracked or untracked delivery, the client will receive a tracking number if applicable, allowing them to track the progress of their parcel until delivery. Tracking information will be accessible on the designated carrier’s website if tracking is available.

7.5. Product Receipt

Upon receipt of the products, it is the client’s responsibility to check the condition of the products in the presence of the carrier. Any anomalies regarding the delivery (missing product, damaged package, etc.) must be immediately reported to the carrier and to BeldiMade via email.

7.6. Delivery Failure

In the event of a delivery failure to the provided address (absence of recipient, incorrect delivery information, etc.), the carrier will leave a notice or call the client directly to arrange another delivery attempt. It is the client’s responsibility to make necessary arrangements to retrieve the package as defined by the carrier. If the package is returned to the sender because it was impossible to deliver for reasons attributable to the client, the return costs and any potential reshipping costs will be borne by the client.

7.7. Risk Transfer

The transfer of risks of loss and deterioration of the products occurs as soon as the product is handed over to the carrier by the artisan or cooperative, and thus the products travel at the client’s risk.

8. Right of Withdrawal

8.1. Legal Framework

In accordance with the applicable legal provisions, consumer clients have a right of withdrawal, which they can exercise without penalty and without giving a reason. This right of withdrawal applies to purchases made on the BeldiMade website.

8.2. Withdrawal Period

In accordance with Moroccan law, the client has 7 days from the receipt of the items to exercise their right of withdrawal from BeldiMade without having to justify reasons or pay penalties.

8.3. Exercise of the Right of Withdrawal

To exercise their right of withdrawal, the client must notify BeldiMade, before the withdrawal period expires, of their decision to withdraw through an unambiguous declaration (via the dedicated form). BeldiMade will provide the client with an acknowledgment of receipt of this withdrawal by email without delay.

8.4. Return of Products

Products must be returned in their original condition and complete (packaging, accessories, manual…) allowing their resale in new condition, accompanied by the purchase invoice. Return costs are borne by the client. The return of products must be made within a reasonable time and, in any case, no later than 14 days after the client has communicated their decision to withdraw.

8.5. Refund

The refund of returned items at the invoiced price will be complete, including initial delivery charges, and made within 14 days from the date on which BeldiMade is informed of the client’s decision to withdraw. However, the refund may be deferred until the items are recovered or until the client has provided proof of shipment of these items, the date retained being that of the first of these facts.

8.6. Exceptions to the Right of Withdrawal

In accordance with the regulations, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer’s specifications or clearly personalized.

9. Warranties and Liability

9.1. Legal Warranties

All products sold on BeldiMade benefit from the legal warranty of conformity and the warranty against hidden defects, taking into account the specific characteristics of craftsmanship and handmade items, such as variations in colors or shapes, which are generally not considered hidden defects.

9.2. Limitation of Liability

BeldiMade undertakes to make every effort to ensure the proper functioning and security of its site, as well as the accuracy of the information provided. However, the company cannot guarantee the complete absence of material errors, technical failures, or other issues that could restrict access to the site or undetected defects in the information or products provided.

BeldiMade’s liability cannot be engaged in cases where the non-performance of its obligations is attributable to an act of a third party, the fault of the client, the occurrence of a force majeure event as defined by Moroccan courts, or any other circumstance beyond its reasonable control.

9.3. Information on the Site

BeldiMade reserves the right to correct the content of its site at any time and without prior notice. Although we strive to ensure the reliability of the information contained on the site, BeldiMade cannot be held responsible for errors, omissions, or results that may be obtained from the use of this information.

9.4. Use of the Site

BeldiMade does not guarantee that the site will be free from defects, errors, or bugs, nor that they can be corrected, nor that the site will function without interruption or failure, nor that it is compatible with a specific hardware or configuration other than that expressly validated by BeldiMade.

10. Disputes

10.1. Amicable Resolution

BeldiMade places great importance on client satisfaction. In case of a dispute or claim from a client, the parties agree to seek an amicable solution first. The client is invited to contact BeldiMade customer service to explain the reasons for their dissatisfaction. Customer service undertakes to examine the claim and respond to the client within a reasonable time, either by email or by phone.

10.2. Mediation

If attempts at amicable resolution fail, the client, if a consumer, may submit the dispute to a consumer mediator. Mediation is a voluntary and confidential conflict resolution process. BeldiMade will provide the client with the necessary information on how to contact the competent mediator.

10.3. Judicial Recourse

In case of failure of amicable resolution or mediation, the dispute may be brought before the competent Moroccan courts.

10.4. Applicable Law

These general terms and conditions of sale and the contractual relationships between BeldiMade and the client are subject to Moroccan law.

11. Modifications to the General Terms and Conditions of Sale

11.1. Right to Modify

BeldiMade reserves the right to modify these general terms and conditions of sale at any time. The modifications will take effect immediately upon publication on the website. It is therefore advisable for clients to regularly consult the general terms and conditions of sale to stay informed of the latest changes.

11.2. Application of Modifications

The modified general terms and conditions of sale will apply to all orders placed after the date of their publication. For orders placed before this date, the terms that were in effect at the time of the order will remain applicable.

11.3. Notification of Modifications

Although BeldiMade strives to inform its clients of changes made to the general terms and conditions of sale, it is the client’s responsibility to check the current GTCs before each order. Information on significant changes will, as far as possible, be communicated to clients through the usual communication channels (e.g., email, website, etc.).

11.4. Acceptance of Modifications

By continuing to use the BeldiMade website after the implementation of modifications, the client accepts the new general terms and conditions of sale. If the client does not agree with the modifications made, they have the option not to place an order after the effective date of these modifications.
